Flight Prize at ‘See Sydney and Beyond with Qantas’ Event

  1. General
    1. Registration instructions form part of these Official Rules. Entries must comply with all of these Terms and Conditions to be valid.
    2. By registering for the Competition, the Entrant agrees to be bound by these Official Rules.
    3. Any questions, comments or complaints can be directed to Destination NSW.
  2. Promoter
    1. The Promoter is Destination NSW ABN 52 890 768 976 of Level 2, 88 Cumberland St, Sydney, NSW, 2000.
  3. Participating Countries
    1. Not Applicable.
  4. Eligibility and Entry Conditions
    1. The “Entry Period” is from 12:00am 5 January 2016 (London time) until draw time on the evening of 21 January 2016 (London time).
    2. Entry into this Competition is free and open to all UK citizens aged 18 or over (“Entrant”), excluding media registered with Destination NSW.
    3. The Promoter reserves the right to request verification of age, identity, residential address of the Prize Winner and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final.
    4. The Promoter reserves the right to disqualify any individual who is deemed to be involved in any way in interfering or tampering with the conduct of this Competition in any manner.
    5. Any costs associated with accessing the website/application is the Entrant’s responsibility and are dependent on the internet service provider used. All costs incurred by the Prize Winner must be borne by the Prize Winner, unless these costs are specified by the Prize descriptions provided.
    6. Employees of the Promoter and/or its related companies and/or any agencies associated with the Competition, and members of their respective immediate families, are not eligible to participate in the Competition. “Immediate family” means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee.
    7. Directors, management, employees and their immediate families of Qantas Airways Limited (Qantas) and registered travel companions of employees of Qantas are not permitted to enter.
  5. Format and Structure
    1. Each eligible person (clause 4b above i.e. Entrant) can enter the Competition only once.
    2. Please note, by entering the Competition, you agree to these Terms and Conditions.
    3. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry.
    4. Incomplete, ineligible or incomprehensible entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry.
  6. Cheating, Abuse and Disorderly Behaviour
    1. Any Entrant may be disqualified from this Competition at the discretion of the Promoter for any failure to comply with these Terms and Conditions or cheating in any way such as:
      1. Using any cheats, hacks or other 3rd party “helper” applications or “bots” to simulate human interaction;
      2. Exploiting the application in any way or using the application in any way that circumvents the purpose and conditions of the Competition.
    2. Abusive behaviour, including any use of harassing, negative, or profane language in Entrant submissions will not be tolerated and will also constitute grounds for immediate disqualification.
  7. Judging
    1. The Competition is based where one Prize Winner will be chosen based on the following criteria:
      1. Attendance at the ‘See Sydney and Beyond with Qantas’ event at 19 Greek Street on Thursday 21 January 2016.
    2. The winner will be drawn at random from the list of eligible guests that are in attendance of the ‘See Sydney and Beyond with Qantas’ event on Thursday 21 January 2016.
    3. The Judges’ of the Promoter decision is final and no correspondence will be entered into.
    4. After the Promoter notifies the Prize Winner of the Prize, all future correspondence will then be between the Prize Winner and the Promoter.
    5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
    6. The Promoter reserves the right to disallow any entry and/or refuse to award a Prize where false or misleading details have been given by the Entrant. The Promoter also reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Competition. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
  8. Timings
    1. There will be one Prize Winner selected from Entrants who have entered between the Entry Period. The one Prize Winner will be selected once all Entries are evaluated based on the above criteria. The Prize Winner will be contacted on no later than 21 January 2016.
  9. Prize Winner Notification
    1. The one Prize Winner will be notified on the evening of 21 January 2016.
    2. Should the Promoter be unable to contact the winner, or if the winner is not present on the evening of 21 January 2016, or should the winner be unable to accept the prize, the Promoter reserves the right to award the prize to an alternative winner, drawn in accordance with these terms and conditions.
  10. Prizes
    1. There is (one) 1 individual prize (‘Prize’).
    2. Prize
      1. The prize is two return economy flights from London Heathrow to Sydney, Australia on a Qantas operated and marketed flight. The prize does not include accommodation, transfers, travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated.  Prize travel is subject to Qantas’ General Conditions of Carriage, available at qantas.com.

    3. Prize vouchers will be provided for the prize. The Prize Winner must contact the entity direct not Destination NSW to book their travel. The flight is subject to availability and blackout dates stated by the airline.
    4. The Prize Winner (and their nominated guest) is responsible for travel to and from their residence to London Heathrow International Airport.
    5. The Prize Winner (and their nominated guest) is responsible for other internal transfers in Sydney and NSW to the attractions and activities as not detailed above and any other incidental expenses as a result of using this Prize not detailed above (meals, spending money, other experience and attractions that they may want to visit, insurance, bonds, airport taxes, departure tax, arrival tax, excess luggage, mini bar, visas, telephone charges, spa treatments, room service, gymnasium, business centre fees and laundry). The Prizes provided above are as is.
    6. The Promoter is not liable for any employment leave arrangements or arrangements for family members i.e. annual leave payments, money for babysitting.
    7. Prize travel is subject to the conditions printed on the ticket, prize vouchers and conditions of entry to each venue and attraction. Travel blackout periods and time blackout periods may apply.
    8. You and your guest agree to comply with all reasonable directions of each venue and attraction.
    9. Additional waiver forms may be required to be completed before undertaking and participating in a respective activity.
    10. Unless otherwise agreed, you cannot accrue frequent flyer points and other loyalty scheme points.
    11. You are liable for all visa, quarantine and customs requirements when entering Australia and Sydney.
    12. Conditions of carriage apply on the aircraft and associated flights.
    13. All Prizes are non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. Prizes cannot be used to purchase gift certificates or lay-buys nor can they be re-sold. Prizes must be taken as offered. No modifications or exchanges will be possible. The Promoter accepts no responsibility for any variation in the value, performance or availability of any of the Prizes.
    14. In the event that for any reason whatsoever a Prize Winner does not take an element of the Prize at the time agreed by the Promoter then that element of the Prize will be forfeited by that Prize Winner and cash will not be awarded in lieu of that element of the Prize.
    15. Once the Prizes have been arranged by the Promoter, changes to the travel, accommodation and other Prize arrangements must be made by and are at the expense of the Prize Winner.
    16. The Prize cannot be on-sold on auction websites, classifieds or by other method of re-sale.
    17. The Prize cannot be used for any other promotions/competitions.
    1. Flight Conditions
      1. Prize travel is subject to availability at the time of booking. Prize travel must be booked and ticketed by 26 February 2016 and completed by 26 January 2017. Travel is not permitted between:10 and 24 February, 14 March and 11 April, 10 July and 10 September, 21 October and 14 November, and 2 December 2016 and 15 January 2017.
      2. Qantas makes no representation as to the safety, conditions or other issues that may exist at any destination. Compliance with any health or other government requirements is the responsibility of the prize winner and companion.
      3. The winner and their companion must travel together on prize flights and will not accrue Qantas Frequent Flyer points on the prize travel. An upgrade cannot be purchased on airfares with cash or Qantas Frequent Flyer points.
      4. Entrants’ personal information provided to Qantas in connection with this promotion will be handled in accordance with Qantas’ Privacy Statement, available at qantas.com/privacy.
  1. Publicity Release, Use of Personal Information
    1. The Promoter will collect information (including personal information) from all entries and use it for the purposes of the Competition and for its purposes. Entrants consent to the Promoter disclosing information, including personal information, to third parties for the purposes of the Competition. All personal information provided by Entrants will be held by the Promoter in accordance with the Promoter’s privacy policy.
    2. By submitting an entry, Entrants agree to their entry being made available for public viewing.Entrants acknowledge and agree that the Promoters may at any time in its absolute discretion remove, modify or not display entries submitted for this Competition.This includes (without limitation) any entry which (in the sole opinion of the Promoter) is defamatory, contrary to public standards of decency or otherwise judged inappropriate or offensive.
    3. The Promoter is not responsible or liable in any manner for any content or materials posted in relation to this Competition.
    4. By accepting the Prize, the Prize Winner consents to the Promoter using their details for promotional purposes.
    5. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Competition.
    6. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as Prizes. The Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by it, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services connected with this Competition.
    7. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Entrants or Prize Winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any Prize, or death except for any liability that cannot be excluded by law.
    8. If this Competition is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Competition or to disqualify any individual who has tampered with the entry process.
    9. Under Privacy law, Entrants may access personal information that the Promoter holds about them and seek correction of that information at any time. If Entrants no longer wish the Promoter to notify them of initiatives that the Promoter considers may be of interest to them, they may notify the Promoter by email: [email protected]. If Entrants choose this option, the Promoter will destroy any personal information that it holds about them.   2. Exclusion of Liability
    1. By registering for this Competition each Entrant and subsequent Prize Winner assumes sole liability for any personal injury and/or damage to property caused or claimed to have been caused to him or her as a result of or in connection with participating in this Competition.
    2. These Official Rules do not affect, and are not intended to affect, any rights or remedies a consumer might have, which cannot be excluded under applicable consumer protection laws.
  3. Governing Law and Jurisdiction
    1. These Conditions of Entry are governed by the laws of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of its courts for the resolution of any dispute, difference, controversy or claim arising in connection with these Official Rules and/or this Competition.
